1. Agreement, defined terms, and eligibility

PLEASE READ THESE TERMS OF SERVICE ("TERMS" OR "AGREEMENT") CAREFULLY BEFORE USING THE SERVICE. BY ACCESSING OR USING SWIPEHIRE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND BY OUR PRIVACY POLICY, WHICH IS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE, YOU MUST NOT ACCESS OR USE THE SERVICE.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and SwipeHire, the operator of the career platform available at swipehire.best and through related websites, mobile experiences, and applications (collectively, the "Service").

For purposes of this Agreement: (a) "Account" means the registered profile associated with your sign-in credentials; (b) "Application Materials" means resumes, cover letters, screening answers, and other information submitted or generated in connection with a job application; (c) "Content" means all software, text, graphics, interfaces, and other materials made available through the Service, excluding User Content; (d) "User Content" means information, files, and materials you submit, upload, or make available through the Service, including profile data and Application Materials; and (e) "Subscription" means a paid plan that renews on a recurring basis until cancelled.

Eligibility. You must be at least sixteen (16) years of age and possess the legal capacity to enter into a binding contract in your jurisdiction. If you access the Service on behalf of a company or other legal entity, you represent and warrant that you have full authority to bind that entity to this Agreement, and "you" includes both you individually and that entity.

2. Nature of the Service

SwipeHire is a software platform designed to assist individuals in searching for employment opportunities. The Service aggregates and presents job listings sourced from third parties, evaluates potential fit between a User's background and available roles using automated and artificial-intelligence-assisted methods, facilitates preparation of Application Materials, and may assist with or perform submission of applications according to the permission level selected by the User. The Service may also monitor connected email inboxes for hiring-related correspondence and provide educational AI Coach features.

The Service currently includes, without limitation: (i) a swipe-based job discovery interface; (ii) AI-generated match scores, explanations, and skill-gap analysis; (iii) profile, resume, and preference management; (iv) application drafting, staging, one-click assist, and, on eligible Pro subscriptions, autonomous auto-apply workflows subject to the guardrails described herein; (v) optional read-only Gmail integration for application-status tracking; and (vi) Coach modules covering resume optimization, interview preparation, role exploration, and compensation guidance.

IMPORTANT RELATIONSHIP DISCLAIMER. SwipeHire is a technology tool only. We are not an employer, employment agency, recruiter, staffing firm, broker, or licensed career counselor. We do not guarantee that any User will receive interviews, assessments, offers, or employment. Hiring decisions are made solely by third-party employers, and we exercise no control over those decisions.

3. Account registration and security

Account Creation. Access to certain features requires authentication through Google OAuth. By signing in, you authorize us to receive from Google such account identifiers and profile attributes as are necessary to create and maintain your Account, including your name, email address, and profile image, in accordance with Google's permissions and our Privacy Policy.

Account Security. You are solely responsible for safeguarding the credentials associated with your Google account and for all activities conducted through your SwipeHire Account, whether or not authorized by you. You must promptly notify us at talm13124@gmail.com if you suspect unauthorized access, credential compromise, or any other security incident affecting your Account.

Account Controls. You may sign out of the Service at any time. You may request deletion of your Account and associated personal data through the Profile settings or by contacting us at talm13124@gmail.com. Deletion is subject to the data-retention provisions of our Privacy Policy and any legal obligations requiring limited retention of records.

4. User Content, profile data, and representations

User Content and Profile Information. To use core features of the Service, you must provide career-related information, which may include employment history, skills, education, certifications, projects, languages, compensation expectations, geographic preferences, professional links, responses to employer screening questions, and uploaded resume files in supported formats. Where you upload a resume, the Service may use AI-assisted parsing to extract structured fields; extracted data is presented for your review and confirmation before being saved to your Account.

Accuracy and Truthfulness. You represent, warrant, and covenant that all User Content you provide is accurate, complete, current, and not misleading to the best of your knowledge. You understand that Application Materials generated or submitted through the Service are derived from User Content you supply. You bear sole responsibility for reviewing every draft, cover letter, form response, and submission before it is transmitted to any employer, including submissions performed autonomously under a Pro Subscription.

Sensitive Information. Unless expressly required by a particular job application and knowingly provided by you, you should not include in User Content categories of sensitive personal data that you are unwilling to disclose to prospective employers or to our subprocessors, such as government-issued identification numbers, full dates of birth, financial account details unrelated to employment, or health or disability information protected under applicable law.

5. Job listings, matching, and AI limitations

Third-Party Listings. Job postings displayed through the Service originate from third-party sources and employer sites. We do not create, control, or guarantee the accuracy, completeness, legality, or continued availability of any listing. A role displayed in the Service may be filled, expired, modified, or withdrawn by the employer at any time without notice to us.

AI Matching and Scoring. The Service uses algorithmic and AI-assisted methods to rank listings relative to your profile and stated preferences. Match scores, skill-gap summaries, compensation estimates, and explanatory narratives are provided for informational purposes only. They do not constitute professional advice, an offer of employment, a guarantee of eligibility, or a representation that you will be selected for interview or hire.

Known AI Limitations. Artificial intelligence systems may produce incomplete, outdated, biased, or factually incorrect output. You must independently verify all listing details, employer requirements, and AI-generated content before applying or relying on it. You retain full discretion over which opportunities to pursue.

Plan Limits. The number of listings surfaced in your Discover feed, the depth of match insights available to you, and your daily swipe allowance depend on your Subscription tier (for example, up to ten matches on Free, forty on Plus, and one hundred on Pro, subject to change as described on the Pricing page). We reserve the right to modify feed algorithms, ranking logic, and plan limits with reasonable notice where practicable.

6. Discover interface, filters, and company preferences

Discover Functionality. The Discover experience permits you to indicate interest in a role (for example, by swiping right), decline a role (for example, by swiping left), or use other in-app actions such as "super-like" where made available. Depending on your Subscription and settings, a positive indication of interest may initiate an application workflow.

Filters and Preferences. You may narrow displayed listings using filters such as role type, location, remote-work preference, and other criteria supported by the Service. You may also maintain lists of dream companies, favorite employers, and permanently blocked companies. A blocked company and its associated listings will be excluded from your feed for so long as the block remains active.

Swipe Limits. Daily swipe counts reset at the start of each calendar day in the timezone configured for the Service. Free Accounts are subject to a limited daily swipe quota; paid Subscriptions provide higher or unlimited quotas as described on the Pricing page. Unused swipes do not roll over unless expressly stated.

7. Application workflows and submission modes

General. When you express interest in a role, the Service may prepare Application Materials using your profile, designated primary resume, and AI-generated text. The applicable workflow depends on the classification of the employer's application channel and your active Subscription.

Manual Apply (Free tier). You are directed to the employer's original posting to review requirements and submit an application independently. The Service may provide match insights but does not submit materials on your behalf.

One-Click Assist (Plus tier and above). The Service drafts Application Materials and, on supported applicant tracking system ("ATS") integrations, may pre-populate application forms in a hosted browser session or staging interface. Unless you expressly approve a staged submission, no materials are transmitted to an employer without your review and confirmation.

Autonomous Auto-Apply (Pro tier only). For roles classified as eligible "one-click" ATS submissions, the Service may submit Application Materials to employers on your behalf without per-application confirmation, strictly subject to the authorization, guardrails, and limitations set forth in Section 8 below.

Complex Applications. Listings requiring multi-step, custom, or non-standard application flows ("FORM" or "COMPLEX" classifications) are never submitted autonomously. For such roles, the Service may generate drafts, partially complete supported fields, or direct you to finish remaining steps manually on the employer's website.

No Guarantee of Success. We automatically classify application complexity and eligibility for automation. We do not warrant that any employer portal can be accessed, parsed, or submitted to successfully, that submissions will be accepted, or that technical changes on third-party sites will not disrupt workflows.

8. Agency authorization, auto-apply guardrails, and user controls

Limited Agency Authorization. By enabling assisted or autonomous application features, you hereby appoint SwipeHire as your limited agent solely for the purpose of preparing, and where permitted by your Subscription, submitting Application Materials to employers using information contained in your Account. This authorization is non-exclusive, revocable, and limited to job-search activities performed through the Service.

Auto-Apply Guardrails (Pro tier). Autonomous submissions are further restricted as follows: (i) only listings classified as supported one-click ATS applications are eligible; (ii) the role's match score must meet or exceed the minimum threshold then in effect (currently eighty (80) points); (iii) the number of autonomously submitted applications per Account is capped on a rolling daily basis (currently twenty (20) per calendar day); (iv) listings from companies on your blocked list are excluded; and (v) we may impose additional technical, fraud-prevention, or compliance restrictions at any time.

User Review and Revocation. You may review application history, pending drafts, submission status, and timeline events within the Service. You may revoke authorization for future autonomous submissions by downgrading your Subscription, disabling applicable settings where available, or ceasing use of the Service. Revocation does not withdraw applications already submitted to employers prior to the effective time of revocation.

Prohibition on Misrepresentation. Nothing in this Agreement authorizes you or the Service to misstate your qualifications, fabricate credentials, impersonate any person or entity, or submit Application Materials that you know or should know to be false or misleading.

9. Gmail integration and email intelligence

Scope of Access. During Google authentication, the Service requests read-only access to your Gmail mailbox via the gmail.readonly OAuth scope. This access is used exclusively to identify and classify messages reasonably related to your job search, including interview invitations, coding assessments, scheduling messages, offer letters, and rejection notices.

Permitted and Prohibited Uses. We use Gmail data solely to update your in-app application tracker and provide timely status notifications. We do not send email on your behalf through Gmail, do not use Gmail content for advertising or unrelated profiling, and do not sell Gmail-derived data. Message bodies are not retained beyond what is reasonably necessary to classify and associate a message with an application record.

Google Policy Compliance. Our access, use, storage, and transfer of information received from Google APIs comply with the Google API Services User Data Policy, including the Limited Use requirements. You may revoke Gmail access at any time through your Google Account permissions dashboard or by contacting us at talm13124@gmail.com. Revocation may limit inbox-tracking functionality but does not automatically delete previously derived application-status records already stored in your Account.

10. AI Coach tools and informational content

The Coach module provides educational resources and AI-assisted guidance on topics including resume structure, interview preparation, occupational exploration, and salary negotiation strategy. All Coach output is provided for general informational purposes only and does not constitute legal, tax, financial, immigration, or individualized career counseling.

Access to certain Coach features may be limited by Subscription tier; Pro subscribers receive the fullest access. Coach responses may incorporate context from your profile but must be independently verified before use in applications, interviews, or compensation discussions. We disclaim any liability arising from reliance on Coach content.

11. Subscriptions, billing, taxes, and refunds

Plan Tiers. SwipeHire offers Free, Plus, and Pro tiers. Current pricing, feature entitlements, swipe limits, feed caps, auto-apply availability, and Coach access are displayed on the in-app Pricing page and may be updated from time to time. Features available on a paid tier at the time of purchase may change; material reductions will be communicated with reasonable advance notice where required by law.

Automatic Renewal. Paid Subscriptions renew on a recurring monthly basis until cancelled. By purchasing a Subscription, you authorize us and our payment processor (currently Stripe or another provider we designate) to charge your designated payment method at the then-current rate, plus applicable taxes, on each renewal date until you cancel.

Cancellation. You may cancel a paid Subscription at any time through account settings or by contacting talm13124@gmail.com. Cancellation takes effect at the end of the current paid billing period unless otherwise disclosed at checkout. You will retain access to paid features until the end of that period.

Refunds. Except where mandatory under applicable consumer-protection law, all fees are non-refundable and non-creditable once a billing period has commenced. Downgrading from a paid tier does not entitle you to a pro-rata refund for the unused portion of the billing cycle.

Payment Failures and Changes. If a charge is declined, we may suspend paid features, downgrade your Account, or retry billing in accordance with our payment processor's rules. We may modify Subscription prices or features upon reasonable notice; continued use or renewal after the effective date of a price change constitutes acceptance of the new pricing.

Taxes. Stated prices may exclude applicable sales, VAT, or similar transaction taxes, which will be added at checkout where required.

12. Acceptable use policy

You agree to use the Service only for lawful purposes and in compliance with this Agreement and all applicable laws and regulations. Without limiting the foregoing, you shall not:

(a) use the Service for any fraudulent, deceptive, harassing, defamatory, or unlawful activity;

(b) scrape, crawl, harvest, reverse engineer, decompile, disassemble, or attempt to derive source code, underlying models, datasets, or non-public APIs of the Service, except to the extent such restriction is prohibited by applicable law;

(c) circumvent, disable, or interfere with plan limits, rate limits, authentication controls, or security features;

(d) submit Application Materials containing false credentials, misrepresentations, plagiarized content, or information belonging to another person;

(e) use the Service in any manner that violates the terms, policies, or robots rules of any employer, job board, Google, email provider, or other third party;

(f) upload malware, interfere with the Service's operation, impose unreasonable load on our infrastructure, or attempt unauthorized access to systems or Accounts; or

(g) resell, sublicense, or commercially exploit the Service except as expressly permitted in writing by us.

We reserve the right to investigate suspected violations, cooperate with law enforcement, and suspend or terminate any Account engaged in prohibited conduct, with or without prior notice where permitted by law.

Independent Third Parties. Job listings, employer websites, ATS portals, background-check providers, and hiring decisions are controlled by third parties unaffiliated with SwipeHire. We do not endorse any employer, verify the legitimacy of every listing, guarantee compensation or working conditions described in postings, or control how third parties evaluate, store, or respond to your applications.

Third-Party Terms. When you apply to a role or visit an external site linked from the Service, you may become subject to that employer's and job board's terms of use, privacy policies, and application requirements. It is your responsibility to review those terms before submitting Application Materials.

Integrations. The Service integrates with third-party providers solely to operate the product, including Google (authentication and Gmail), cloud hosting and database infrastructure, AI model providers (such as Anthropic and OpenAI), payment processors, and browser-automation infrastructure for supported ATS workflows. Your use of integrated services may be governed by those providers' separate terms.

Links. Hyperlinks to external resources are provided for convenience only. We assume no responsibility for the content, availability, security, or privacy practices of third-party websites.

14. Intellectual property rights and licenses

Our Property. The Service, including all Content, software, source and object code, visual design, trademarks, service marks, logos, and documentation, is owned by SwipeHire or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license expressly granted herein, no rights are transferred to you.

Limited License to Users. Subject to your compliance with this Agreement, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your individual job-search purposes.

Your User Content. You retain ownership of User Content you submit. By providing User Content, you grant SwipeHire a worldwide, royalty-free license to host, store, reproduce, process, adapt, display, and transmit User Content solely as necessary to operate, maintain, and improve the Service, including sharing Application Materials with employers when you direct us to apply. You represent that you have all rights necessary to grant this license.

Feedback. If you submit suggestions, ideas, or feedback regarding the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without restriction or compensation to you.

15. Disclaimers of warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL CONTENT, AI OUTPUT, MATCH SCORES, LISTINGS, AND COACH MATERIALS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

WE EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (A) LISTINGS ARE CURRENT, COMPLETE, OR FREE FROM ERROR; (B) MATCH SCORES OR AI OUTPUT ARE CORRECT OR RELIABLE; (C) APPLICATIONS WILL BE RECEIVED, REVIEWED, OR CONSIDERED BY EMPLOYERS; (D) YOU WILL OBTAIN INTERVIEWS, OFFERS, OR EMPLOYMENT; OR (E) THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

YOU ACKNOWLEDGE THAT AI-GENERATED TEXT MAY CONTAIN FACTUAL ERRORS, OMISSIONS, OR INAPPROPRIATE CONTENT. YOU BEAR SOLE RESPONSIBILITY FOR REVIEWING ALL OUTPUT BEFORE SUBMISSION TO ANY THIRD PARTY. NO ORAL OR WRITTEN STATEMENT BY US OR OUR REPRESENTATIVES SHALL CREATE ANY WARRANTY NOT EXPRESSLY SET FORTH IN THIS AGREEMENT.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SWIPEHIRE, ITS OWNERS, OPERATORS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR ANTICIPATED SAVINGS, ARISING OUT OF OR RELATED TO THIS AGREEMENT OR YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THIS AGREEMENT SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO SWIPEHIRE FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) FIFTY U.S. DOLLARS (USD $50).

Some jurisdictions do not permit exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law. Nothing in this Agreement excludes liability that cannot be excluded under mandatory consumer-protection statutes.

17. Indemnification

You agree to defend, indemnify, and hold harmless SwipeHire and its owners, operators, affiliates, officers, directors, employees, contractors, and agents from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to: (a) your use of the Service; (b) your User Content or Application Materials; (c) applications submitted on your behalf; (d) your breach of this Agreement; or (e) your violation of any applicable law or the rights of any third party, including any employer or job board.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate fully with our defense of such claim.

18. Suspension, termination, and survival

Termination by You. You may cease using the Service at any time and may delete your Account through Profile settings or by written request to talm13124@gmail.com. Account deletion initiates removal of personal data as described in our Privacy Policy, subject to permitted retention exceptions.

Termination by Us. We may suspend or terminate your access to the Service, in whole or in part, immediately and without prior notice if we reasonably believe you have violated this Agreement, pose a security or legal risk, fail to pay applicable fees, or if we are required to do so by law. We may also discontinue the Service or any feature with reasonable notice where practicable.

Effect of Termination. Upon termination, your license to use the Service ends immediately. Sections that by their nature should survive termination shall survive, including provisions relating to User Content licenses already exercised, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution.

19. Modifications to this Agreement

We may amend this Agreement from time to time in our sole discretion. The "Last updated" date at the top of this page indicates the effective date of the current version. If we make material changes, we will provide notice through the Service, by email to the address associated with your Account, or by other reasonable means prior to the effective date where required by law.

Your continued access to or use of the Service after the effective date of revised Terms constitutes your binding acceptance of the changes. If you do not agree to amended Terms, you must stop using the Service and may delete your Account before the effective date.

20. Governing law, jurisdiction, and informal resolution

Governing Law. This Agreement and any dispute arising out of or relating to it or the Service shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict-of-law principles.

Jurisdiction. Subject to mandatory consumer-protection provisions that may apply in your jurisdiction, you agree that the competent courts located in Tel Aviv-Jaffa, Israel shall have exclusive jurisdiction over any dispute, claim, or controversy arising from or relating to this Agreement or the Service.

Informal Resolution. Before initiating formal legal proceedings, you agree to contact us at talm13124@gmail.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days. Nothing in this Section limits either party's right to seek injunctive or equitable relief for misuse of intellectual property or unauthorized access to the Service.

For questions, legal notices, or support regarding this Agreement, please contact us at talm13124@gmail.com. Please include sufficient detail to identify your Account (such as the email address used to sign in). We will endeavor to respond within a commercially reasonable timeframe.

22. Electronic communications and notices

By creating an Account or providing an email address, you consent to receive communications from us electronically, including service announcements, billing receipts, application-status notifications, security alerts, and legal notices. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

Legal notices to SwipeHire must be sent to talm13124@gmail.com. Notices to you may be delivered to the email address associated with your Account or through prominent posting within the Service.

23. General provisions

Entire Agreement. This Agreement, together with the Privacy Policy and any Subscription terms presented at checkout, constitutes the entire agreement between you and SwipeHire regarding the Service and supersedes all prior or contemporaneous understandings on the subject matter.

Severability. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

No Waiver. Our failure to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of SwipeHire.

Assignment. You may not assign or transfer this Agreement or any rights hereunder without our prior written consent. We may assign this Agreement in connection with a merger, acquisition, corporate reorganization, or sale of assets, or to an affiliate, upon notice to you where required by law.

Force Majeure. We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, war, terrorism, labor disputes, internet or utility failures, government actions, or failures of third-party hosting or AI providers.

Headings. Section headings are for convenience only and do not affect interpretation.
